During the eighteenth century, the specter of atheism was a major concern among many intellectuals in Europe. Many of the leading figures of the period such as François-Marie Arouet de Voltaire refuted atheism at every turn. These debates centered on living organisms, particularly questions about generation. Efforts to explain the process of generation raised biological, religious, and political questions. One popular theory put forward to address the question of generation was preformation, the belief that “germs” had been in existence since (...) God created the world. This chapter first discusses the rise of preformationist thinking in the late seventeenth century before turning to the biological evidence that challenged preexistence in the mid-eighteenth century and analyzing the reaction it triggered among the preformationists. It also examines the work of Voltaire and Denis Diderot to illustrate how the generation debates are linked to the materialism question. The chapter concludes by showing how these controversies about nature and biology became entangled with politics in eighteenth-century France. (shrink)

IntroductionThe use of tissue from fetal remains for transplantation and biomedical research has become a controversial issue in recent years, involving scientists, doctors, patients, and the federal government. Fetal tissue is potentially useful in a wide range of treatments for a number of serious diseases, some of them affecting millions of people. Despite the promise, transplantation research using fetal tissue from induced abortion (...) slowed dramatically in the U.S. in 1988, when a moratorium was declared on federal funding for such research involving humans. That moratorium was lifted by President Clinton on January 21, 1993. Though the future of fetal tissue transplantation research is brighter, public debate on the issue is likely to continue, exacerbated by the "acrimonious abortion debate" (VI, Post 1991, p. 14).Using fetal tissue in biomedical research and in transplantation is not a new practice. As early as 1928 unsuccessful attempts were made to transplant fetal pancreas cells into diabetics (VII, Fichera 1928). Fetal tissue was used effectively in biomedical research during the 1950s, and was instrumental in the culture of the polio virus, which led to the development of the polio vaccine. Fetal tissue cultures were also essential in the development of the rubella vaccine, and continue to be used in virology research. Transplantation of fetal thymus cells into patients with DiGeorge Syndrome has been recognized as effective therapy since the late 1960s.Many of the therapeutic applications involving fetal tissue are still experimental, so it is difficult to pinpoint fetal tissue transplantation's therapeutic potential. One promising application is the transplantation of human fetal brain cells into the substantia nigra of patients with Parkinson's disease to restore motor function. Fetal neural transplants have also shown promise for patients suffering from Alzheimer's disease, spinal cord and other neural tissue injuries, and possibly some forms of cortical blindness. Fetal liver cells may be useful for treatment of some kinds of bone marrow disease seen in leukemia and aplastic anemia patients. [End Page 81] Fetal tissue transplantation may also help those suffering from blood clotting disorders, such as sickle cell anemia, thalassemia, and hemophilia. Martin Folkes (1690–1754) was Newton's protégé, an English antiquary, mathematician, numismatist and astronomer who would in the latter part of his career become simultaneously president of the Royal Society and of the Society of Antiquaries. Folkes took a Grand Tour from March 1733 to September 1735, recording the Italian leg of his journey from Padua to Rome in his journal. This paper examines Folkes's travel diary to analyse his Freemasonry, his intellectual development as a Newtonian and his scientific peregrination. It (...) shows how, in this latter area, how he used metrology to understand not only the aesthetics but also the engineering principles of antique buildings and artefacts, as well as their context and place in the Italian landscape. Using Folkes's diary, his account book of his journey in the Norwich archives, and his correspondence with other natural philosophers such as Francesco Algarotti (1712–1764), Anders Celsius (1701–1744) and Abbé Antonio Schinella Conti (1667–1749), this paper will also demonstrate to what extent Folkes's journey established his reputation as an international broker of Newtonianism, as well as the overall primacy of English scientific instrumentation to Italian virtuosi. The loss of the federally protected constitutional right to an abortion is a threat to the already tenuous autonomy of pregnant people, and may augur future challenges to their right to refuse unwanted obstetric interventions. Even before Roe’s demise, pregnancy led to constraints on autonomy evidenced by clinician-led legal incursions against patients who refused obstetric interventions. In Dobbs v. Jackson Women’s Health Organization, the Supreme Court found that the right to liberty espoused in the Constitution does not extend to a (...) pregnant person’s right to an abortion. With Roe’s demise, the right to request specific types of care has been vitiated. The same argument underpinning that holding may now become ballast for attacks on the traditionally more robust right, the right to refuse. Here we discuss how the elevation of fetal and embryonic rights may lead to a cascade of medical intrusions and deprivations of liberty against pregnant persons, and offer an argument opposing these improprieties. This article details the extremely broad range of legal claims, compares the opioid cases to other public health litigation efforts, including tobacco, and describes the special mechanism — a multidistrict litigation — through which more than 700 opioid-related cases have been consolidated thus far, with settlement almost certain to follow.

Yet few would have thought this inquisitive, untidy, nature-loving child would become "one of the sharpest critical pens in the west." This is her remarkable story. Probably the only philosopher to have been in Vienna on the eve of its invasion by (...) Nazi Germany in 1938 and dance in Trafalgar Square on VE day seven year later, she studied philosophy at Oxford in the same year as Iris Murdoch, Elizabeth Anscombe and Philippa Foot, all of whom became close friends. Midgley tells us in vivid and humorous fashion how they cut a swathe through the arid landscape of 1950s British philosophy, writing and arguing - often with each other - about the grand themes of character, beauty and the meaning of rudeness while the spectral figure of Ludwig Wittgenstein hovered in the background. She also charts the highs and lows of philosophy and academia in Britain. On joining the Reading philosophy department on £400 a year in 1949, she doubled its staff complement. But her many years at Newcastle University - where Mike Brearley, who later captained England at cricket, also used to teach - were rewarded with the closure of the philosophy department in the 1980s. The mother of three children, her journey is also one of a woman who in the 1950s and 1960s was fighting to combine a professional career with raising a family. In startling contrast to many of the academic stars of her generation, we learn that Midgley nearly became a novelist and started writing philosophy only when in her fifties, suggesting that Minerva's owl really does fly at dusk. Plainly told like her philosophy, this is an elegiac and moving account of friendships found and lost, bitter philosophical battles and of a profound love of teaching all too rarely acknowledged today. Many of Søren Kierkegaard's most controversial and influential ideas are more relevant than ever to contemporary debates on ethics, philosophy of religion and selfhood. Kierkegaard develops an original argument according to which wholeheartedness requires both moral and religious commitment. In this book, Roe Fremstedal provides a compelling reconstruction of how Kierkegaard develops wholeheartedness in the context of his views on moral psychology, meta-ethics and the ethics of religious belief. He shows that Kierkegaard's influential account of despair, selfhood, ethics and religion (...) belongs to a larger intellectual context in which German philosophers such as Kant and Fichte play crucial roles. Moreover, Fremstedal makes a solid case for the controversial claim that religion supports ethics, instead of contradicting it. This paper closely examines Strauss’ conception of “Medieval Enlightenment”. It focuses on the central role that Arab philosophy has played in the development of Strauss’s thought and discusses the validity of the uses he makes of it. It also emphasizes the interest of Strauss’s analyses as regards Arab philosophy while drawing attention to the tensions they create. It claims that Strauss’ involvement in the quarrel between Ancients and Moderns aims at showing that medieval philosophy cannot be reduced simply to the (...) effort to reconcile philosophy and religion. The ideas of some Arab philosophers cropped up throughout Strauss’s philosophical development and determined his interpretation of Maimonides and Plato as well as his stance in opposition to the moderns. However Strauss’s idea of the “medieval Enlightenment” remains fundamentally ambiguous. Is that Enlightenment supposed to be an argument for the preservation of faith alongside reason or does it rather express a kind of atheism or disguised materialism? (shrink)

We applaud the spirit of MacNeilage's attempts to better explain the evolution and cortical control of speech by drawing on the vast literature in nonhuman primate neurobiology. However, he oversimplifies motor cortical fields and their known individual functions to such an extent that he undermines the value of his effort. In particular, MacNeilage has lumped together the functional characteristics across multiple mesial and lateral motor cortex fields, inadvertantly creating two hypothetical centers that simply may not exist.

This article tries to make sense of the concept of the highest good (eternal bliss) in Søren Kierkegaard by comparing it to the analysis of the highest good found in Immanuel Kant. The comparison with Kant’s more systematic analysis helps us clarify the meaning and importance of the concept in Kierkegaard as well as to shed new light on the conceptual relation between Kant and Kierkegaard. The article argues that the concept of the highest good is of systematic importance in (...) Kierkegaard, although previous research has tended to overlook this, no doubt due to Kierkegaard’s cryptic use of the concept. It is argued that Kierkegaard’s concept of the highest good is much closer to Kant’s than what previous research has indicated. In particular, Kant and Kierkegaard see the highest good not only as comprising of virtue and happiness (bliss), but also as being the Kingdom of God. (shrink)

By comparing the theories of evil found in Kant and Kierkegaard, this article aims to shed new light on Kierkegaard, as well as on the historical and conceptual relations between the two philosophers. The author shows that there is considerable overlap between Kant's doctrine of radical evil and Kierkegaard's views on guilt and sin and argues that Kierkegaard approved of the doctrine of radical evil. Although Kierkegaard's distinction between guilt and sin breaks radically with Kant, there are more Kantian elements (...) in Kierkegaard than was shown by earlier scholarship. Finally, Kierkegaard provides an alternative solution to the problem of the universality of guilt, a problem much discussed in the literature on Kant. (shrink)

The next steps in health reform, like all such efforts before it, will have to engage the issue of American health care federalism – the relationship between the federal and state governments in the realm of health law and policy. Since its enactment in 2010, the Patient Protection and Affordable Care Act has offered a robust example of modern federalism and revealed new complexities. This article recounts the findings of our five-year study of the federalist and nationalist features of ACA (...) implementation. Contrary to the claims of ACA opponents that the law marked a federal “takeover,” the ACA's governance structures have advanced rather than suppressed state power. But we also found that the advances in state power occurred seemingly independently of the statute's structural arrangements; that is, the ACA's nationalist and federalist features both enhanced state power over health policy. These findings raise questions about whether cherished American federalism values are unique to federalist structures; they also raise the question of what exactly health care federalism is for, and why we continue to design health policy with federalism front and center. It is not clear that enhanced state power has brought better health policy. If it has not, is federalism for its own sake worth the trade-off? (shrink)

Kierkegaard and Kant on Radical Evil and the Highest Good is a major study of Kierkegaard's relation to Kant that gives a comprehensive account of radical evil and the highest good, two controversial doctrines with important consequences for ethics and religion.

The aim of this paper is to clarify Kierkegaard’s concept of demonic despair (and demonic evil) and to show its relevance for discussions of the guise of the good thesis (i.e. that in f-ing intentionally, we take f-ing to be good). Contemporary discussions of diabolic evil often emphasise the phenomena of despair and acedia as apparent counter-examples to the guise of the good. I contend that Kierkegaard’s analysis of despair is relevant to these discussions, because it reconciles demonic (extreme) despair (...) and acedia with the guise of the good. In The Sickness unto Death, Kierkegaard provides an influential, systematic account of despair that relates evil, despair, and acedia to each other. Michelle Kosch argues that this account goes beyond Kierkegaard’s German predecessors by introducing a concept of diabolic evil and despair. By contrast, the present paper argues that Kierkegaard takes diabolic evil to be impossible, although he offers a rich analysis of the demonic that resembles diabolic agency. Still, Kierkegaard’s analysis rests on ontological assumptions about the nature of the good that belong to a Platonico-Christian tradition that is controversial today. (shrink)

This chapter focuses on how Kierkegaard criticizes both eudaimonism and Kantian autonomy for failing to account for unconditional obligations and genuine other-regard. Like Kant, Kierkegaard argues that eudaimonism makes moral virtue contingent on prudence. Kierkegaard views eudaimonism as an anthropocentric and self-regarding doctrine, which he contrasts not with Kantian autonomy but with theocentrism and proper other-regard. Kierkegaard then criticizes Kantian autonomy in much the same way as he criticizes eudaimonism. Whereas eudaimonism makes morality contingent on prudence, autonomy makes morality contingent (...) on decisions that may be revoked, he argues. As a result, human autonomy can account for hypothetical imperatives but not categorical imperatives. This line of reasoning seems problematic, however, since Kierkegaard takes Kantian autonomy to not only represent a form of moral constructivism, but also a form of moral relativism and decisionism. Still, Kierkegaard’s critique of autonomy indicates that morality and practical rationality need unconditional commitment towards what is objectively good. (shrink)

In the Philippines, all transplant centers are mandated by the Department of Health (DOH) to have a Hospital Transplant Ethics Committee (HTEC) to ensure that donations are altruistic, voluntary and free of coercion/commercial transactions. This study was undertaken primarily to describe the organizational and functional profile of existing HTECs and identify areas for improvement. This is a descriptive cross‐sectional study. There was variation in their logistical arrangements (support from hospital, filing systems, office spaces), operations (length and frequency of meetings, number (...) of referrals) and membership (composition, qualifications, occupation, training). The approval rate for donor‐recipient pairs is high with the majority of cases made by living non‐related donors. Appropriate reasons were cited for rejection. The perception of HTECs is that they are competent and confident in their decision‐making. However, there is a need to standardize HTEC composition, provide operating procedures and additional training which can be done by the DOH. (shrink)

Litigation cannot solve a public health crisis. But litigation can be an effective complementary tool to regulation by increasing the salience of a public health issue, eliciting closely guarded information to move public opinion, and prompting legislative action. From tobacco to opioids, litigants have successfully turned to courts for monetary relief, to initiate systemic change, and to hold industry accountable For years, litigators have been trying to push firearm suits into their own litigation moment. But litigation against the gun industry (...) poses special challenges. Not only has the regulatory regime failed to prevent a public safety hazard, Congress has consistently underfunded and understaffed the relevant regulatory actors. And in 2005 it legislatively immunized the gun industry from suit with the Protection of Lawful Commerce in Arms Act. This paper surveys the field of litigation in response to gun violence, tracking the limited successes of victims and stakeholders suing the gun industry. We find that victories remain confined to individual actors and unlike high-impact public litigations in other areas, aggregate class actions and major public litigation led by state attorneys general are noticeably absent in the firearm context. By endowing technology with the attributes of autonomous agency, human beings are ethically sidelined. Individuals are relieved of responsibility. The suggestion of being in the grip of irresistible forces provides an excuse for rejecting responsibility for oneself and others, thus creating conditions for inappropriate or antisocial behavior. It also impedes the search for solutions to pressing social problems associated with applications of technology. Failure to assign and accept responsibility for decisions to deploy “conventional” technology will inevitably impede our ability to (...) deal with the social and ethical challenges of robotics.
